Terms of Service
In force from 5 October 2026 · edition 2026-10-05
These terms are the contract between you, the business that holds a SearchWinery account, and us, the operator of SearchWinery. You accept them when you register.
1. Who we are
SearchWinery is operated by Marc Artigas Sanchez, sole trader, tax ID (NIF) 38837917W, Can Guardiola, sn, 08339 Vilassar de Dalt, Barcelona — “we” and “us” in these terms. You can reach us at hola@searchwinery.com.
2. For businesses only
SearchWinery is sold only to businesses: wine producers, bottlers, cooperatives, and those acting for them. By registering you confirm that you act for the purposes of your trade, business or profession and not as a consumer, and that you may bind the business you register for. Rules that protect consumers only, such as the right of withdrawal, therefore do not apply. Prices are shown excluding VAT.
3. Your account
- Give accurate information when you register, and keep it accurate.
- Keep your password to yourself. You are responsible for what is done with your account; tell us at once if you think someone else has used it.
- We approve each account by hand before its first e-label is published, and may refuse to, for example when we cannot confirm that you may publish for the winery you name.
4. What SearchWinery does
SearchWinery lets you record your wineries, wines, bottlings, laboratory analysis and ingredients; calculates the nutrition declaration from the values you enter, using the energy factors of Annex XIV to Regulation (EU) No 1169/2011 and the Commission's rounding guidance; renders the ingredient list and nutrition declaration in the EU languages from a controlled vocabulary; publishes each bottling as an e-label at a permanent address with a QR code to print; and gives your winery a public page.
It is a tool. We do not check that what you enter is true, complete or lawful, and nothing in the service is legal advice.
5. Your responsibility for your e-labels
- You are the food business operator responsible for the labelling of your wine — under Regulation (EU) No 1169/2011, article 8, and Regulation (EU) No 1308/2013 as amended by Regulation (EU) 2021/2117. Publishing an e-label is your declaration, made in your winery's name. The person who confirms a publication is recorded against it.
- Before you print a QR code or publish an e-label, check it: the values you entered, the ingredient list, the calculated declaration, the mandatory particulars we give you for the physical label, and the wording in the language of every market where the wine is sold.
- The wording in some languages has not yet been checked against the Official Journal of the European Union. The back office names those languages wherever you choose or confirm wording; have them checked by someone who reads the language before you rely on them.
- If you find an error in our calculation or our wording, tell us. We will correct it, and you can publish the corrected e-label as a new version free of charge.
6. What you may publish
Everything you enter — e-label data, winery details, the link to your website — must be lawful, accurate, and yours to publish. You must not:
- publish for a winery you do not represent, or impersonate anyone;
- enter false or misleading information;
- infringe anyone's intellectual property or other rights;
- put sales or marketing content on an e-label, including through the names of wines or lots — the regulation forbids it, and the service is built not to allow it;
- link your winery page to anything unlawful, harmful or deceptive;
- try to reach other accounts' data, probe or overload the service, or use it to spread malware or spam.
7. How we act on content
We do not monitor what is published in general. We act when we approve an account, when we receive a report under section 8, and when an authority orders us to. Where content breaks the law or these terms we may, depending on how serious it is: decline to approve the account; hide or correct the winery page or the link on it; stop the account publishing new e-labels; or suspend the account. These decisions are made by a person, not by an automated system.
We will tell you what we did and why — the facts, the rule it rests on, and how to contest it (Regulation (EU) 2022/2065, article 17) — unless the law prevents us. To contest a decision, reply to hola@searchwinery.com; we will review it and answer within 14 days.
A published e-label stays online even when your account is restricted, because bottles in the market depend on it. We will take one down only when an authority orders it, or when serving it would itself be unlawful, and we will tell you first unless the law prevents us.
8. Reporting illegal content
Anyone may report content on SearchWinery that they believe is illegal by writing to hola@searchwinery.com (Regulation (EU) 2022/2065, article 16). Please include:
- why you consider the content illegal;
- the exact address (URL) where it appears;
- your name and email address;
- a statement that you believe, in good faith, that the report is accurate and complete.
We confirm receipt, look at every report diligently and objectively, and tell you what we decided and how you can seek redress.
9. Plans, prices and payment
- The free plan includes three e-labels. The paid plans, their prices and their limits are on our home page. Prices exclude VAT.
- Payment is handled by Creem, which acts as merchant of record: Creem sells you the subscription, charges your card, issues your invoice and handles VAT, including the reverse charge when you give a valid EU VAT number. Creem's own terms apply to the payment.
- Paid plans are yearly and renew automatically at the price then in force for your plan, unless you cancel before the renewal date in the customer portal, reached from the Plan page in the back office. We will tell you of a price change at least 30 days before the renewal it affects.
- Moving to a larger plan takes effect at once and is charged for the rest of the current year. Moving to a smaller plan costs nothing today: the lower price starts at your next renewal, and the smaller plan's limits apply straight away.
- Fees already paid are not refunded, except as section 11 says.
- The limits of a plan only stop you adding e-labels or wineries. Nothing you have already published or registered is taken away over a plan or a payment.
10. Your published e-labels
Each e-label you publish stays online, at the same address and free of charge, for at least 10 years after its most recent publication — whether you change plan, stop paying, close your account, or we restrict it. Correcting a published e-label is always free, never counts against your plan, and restarts that period. Every earlier version is kept, so you can show what a bottle displayed on a given date.
After that period we may keep serving an e-label, or retire it after telling you at least six months beforehand. A retired address is never given to anything else.
11. If we stop providing SearchWinery
We may discontinue the service for justified reasons. If we do, we will:
- tell you at least six months before it ends;
- refund any fees you paid for the time after it ends;
- on request, give you the content of your published e-labels in a machine-readable form; and
- try to transfer the service, including the e-label addresses, to a successor who takes on section 10.
12. Availability
We work to keep SearchWinery, and the e-labels above all, available at all times, but we do not promise uninterrupted service. We may interrupt the back office for maintenance, and we are not responsible for interruptions caused by events beyond our reasonable control.
13. Your content and ours
What you enter remains yours. You grant us a worldwide, non-exclusive, royalty-free licence to store, reproduce, format and translate it and to make it public as e-labels, QR codes and winery pages, for as long as section 10 requires — which may be after your account has closed. You confirm that you may grant it.
The software, its design, the SearchWinery name and logo, and the ingredient vocabulary and its translations are ours. While your account is open you may use them as the service intends. The QR codes of your e-labels are yours to print as you wish.
14. Liability
Nothing in these terms limits liability for wilful misconduct, for gross negligence, or for anything else the law does not allow to be limited. Within that:
- We are not liable for indirect or consequential loss — lost profit, lost sales, damage to reputation — nor for the cost of relabelling, withdrawing or recalling wine, or for fines, that result from data you entered or wording you did not check.
- Our total liability to you in any twelve months is limited to the fees you paid us in those twelve months, or €100 if that is more.
15. Claims about your content
You will compensate us for claims by third parties and sanctions by authorities that arise from the content you publish or from your breach of these terms, including reasonable legal costs.
16. Closing an account
You may close your account at any time by writing to hola@searchwinery.com from the address you registered with. Cancel a paid plan in the customer portal first; the current year is not refunded. We may suspend or close an account for a serious or repeated breach of these terms, or where the law requires it, as section 7 describes. Sections 10, 11, 13, 14, 15 and 18 continue after an account closes.
17. Changes to these terms
We may change these terms for legal, technical or business reasons. We will tell you at least 30 days before a change that is to your disadvantage takes effect, and ask you to accept the new edition before you next use the back office. If you do not accept it, you may close your account; section 10 still applies to your published e-labels. Earlier editions are available on request.
18. Law, courts and language
These terms are governed by Spanish law. Because both parties act as businesses, any dispute will be settled by the courts of the city of Barcelona (Spain).
These terms are written in English, Catalan and Spanish. If the versions differ, the English version prevails.
19. Personal data
How we handle personal data is in the Privacy Policy, which is not part of this contract.
